Acceptance of Terms

By downloading, installing, or using the HxF application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and AGI Automation LLC ("Company", "we", "us", or "our").

Medical Disclaimer

IMPORTANT: HxF provides general health and fitness information for informational and educational purposes only. The App is NOT a medical device and is NOT intended to:

Diagnose, treat, cure, or prevent any disease or medical condition
Replace professional medical advice, diagnosis, or treatment
Serve as a substitute for consultation with qualified healthcare providers

Always consult your physician or other qualified healthcare provider before starting any diet, exercise program, or with any questions regarding a medical condition.

IN CASE OF A MEDICAL EMERGENCY, CALL YOUR LOCAL EMERGENCY SERVICES (911 in the US) IMMEDIATELY. DO NOT USE THIS APP FOR EMERGENCIES.

Description of Service

HxF is an AI-powered health and fitness application that provides:

Conversational AI health coaching and advice
Personalized workout plan generation
Diet and nutrition recommendations
Food photo analysis for nutritional information
Integration with Apple HealthKit for personalized insights

Subscription Terms

Subscription Plans

HxF offers the following subscription options:

Free: 3 AI messages per day, 15 lifetime messages
Pro: $9.99/month or $95.88/year (10 messages/day)
Max: $19.99/month or $179.88/year (25 messages/day)

Free Trial

Paid subscriptions include a 3-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

Billing

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial subscription periods.

Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. You will be notified of any price changes in advance.

User Responsibilities

By using HxF, you agree to:

Provide accurate information when using the App
Use the App only for lawful purposes
Not attempt to circumvent usage limits or security measures
Not use the App to harm, harass, or abuse others
Not reverse engineer, decompile, or disassemble the App
Not use automated systems to access the App

Acceptable Use

You agree NOT to use HxF:

For medical emergencies - call emergency services instead
As a replacement for professional medical care
To generate harmful, illegal, or inappropriate content
To abuse, spam, or overload our services
To violate any applicable laws or regulations

Intellectual Property

The App, including all content, features, and functionality, is owned by AGI Automation LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

AI-generated content may contain errors or inaccuracies. You are responsible for verifying any information provided by the App, especially regarding health and fitness matters.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGI AUTOMATION LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless AGI Automation LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the App or violation of these Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by other means. Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
